The Property has been operated as a C4 small HMO definitely since June 2015 when the current owners purchase it and probably for the 4 years prior, as testified by the previous owner. The property has had a continuous small HMO (PRPL) since December 2016. During the purchase in 2015 the current Owners and their Solicitor were assured by Waltham Forest Council (WFC) that planning permission would not be required for operation in Class C4, via the local area search. In 2022 at the renewal point for the HMO Licence WFC decided that Planning permission would be required due to the Article 4 (C3 / C4) implementation by the Council in 2014 and a restricted Licence renewal was put in place. The Certificate states that given the Bedroom sizes, there is a theoretical capacity in the house for 6 People. During the current ownership there have been no incidents of Anti Social Behaviour and good relations are maintained with Neighbours in the local vicinity. Any reported defects are resolved quickly and the property is in a good condition. This Application is made to put in place the necessary Planning requirement retrospectively.
