Variation to S106 Legal Agreement pursuant to planning permission 2009/1571, dated 17/03/2010, for the demolition of existing buildings and erection of a four to live storey building to provide 36 dwellings (Bx1 bed, 21 x 2 bed, 7 x 3 bed] on first to the fourth floor, retail/commercial at ground floor (A1-A4). Amendments to include: (1) Amend the definition of 'Mortgagee to include housing administrator.' (2)  Add 'other than by way of legal mortgage or charge' into Clause 5.1.3; (3). Amend clauses 3.3 and 3.4 of Schedule 1 so that the mortgagee exclusion clause covers all Affordable Housing provisions to the agreement and insert a conditional mortgagee exclusion clause; (4). Add 'other than by way of legal mortgage or charge' into clause 4 of Schedule 1; (5). Add a clause exempting S/O leaseholders from being bound by the provisions of the S106 so they are excluded from being a party to the deed of variation.
